Terms and conditions of sale and privacy policy.

The General Conditions of Sale below are intended to define the rules applicable within the framework of the on-line sale of products Clap Paris on the site www.clap-paris.com.

By checking the box "I have read the "Terms and Conditions of Sale" and accept them", you agree to these terms and conditions.

These general conditions of sale are concluded by the company Clap Paris domiciled at 37 rue Pouchet 75017 Paris and represented by Laura Freeland (Simplified joint stock company with a capital of 300€, SIRET number: 830 755 419 R.C.S Paris, intra community VAT: FR 67830755419)

And

Any physical person, not commercial, having the legal capacity to contract carrying out a purchase of product on the site.
Any order of a product proposed on the site implies the full and whole adhesion of the customer to the General Conditions of Sale in force at the time of the placing of its order.
The company Clap Paris specifies to you that it is not possible to buy a good without accepting these detailed conditions below.

 

ARTICLE 1 - PURPOSE

The present General Conditions of Sale thus have for object to define the conditions under which the products Clap Paris are marketed. They present the various stages of realization of the sale: since the placing of the order by the customer until the reception of the product by the customer.
The sale is reserved to the major customers or minors with a parental authorization.

Clap Paris reserves the right to modify at any time its General Conditions of Sale by publishing a new version on the site (the General Conditions of Sale applied being those in force at the time of the order by the customer).

 

ARTICLE 2 - CHARACTERISTICS OF THE GOODS OFFERED

The products offered for sale are those listed on the site on the day of its consultation by the customer. Each product is the subject of a descriptive sheet presenting the photographed model and the information relating to the product (price and technical description).

The photographs in the catalogue are as accurate as possible but cannot ensure a perfect similarity with the product offered, particularly with regard to colours.
These products are offered within the limits of available stocks.

 

ARTICLE 3 - PRICES

The prices indicated by the Seller at the time of the order are in Euros, including VAT at the rate in force on the day of the order. Any change of rate will be reflected without delay on the price of the products offered.

For sales outside the European Union, prices are FOB Paris. Customs clearance and payment of various duties or taxes are at the customer's expense.

The Seller reserves the right to modify its prices at any time, it being understood, however, that the prices presented on the Seller's site on the day of the order will be the only ones applicable to the Customer.
The prices indicated include the costs of processing the order.
The transport and delivery costs applied are those indicated on the Site at the time of the order.
The sale price is payable upon placing the order.

Clap Paris reserves the right to modify its prices at any time, being however understood that the price appearing on the catalogue the day of the order will be the only one applicable to the customer.

 

ARTICLE 4 - ORDERING AND PAYMENT OF ITEMS

1- The customer accesses his basket after having added the various products desired. The customer clicks on "Validate the order" (the customer still has the possibility to choose to continue shopping and to complete his basket)

2- The details of the customer's order are displayed, the customer checks and validates his basket

3- Once the order is validated, the customer must identify himself (if he does not have an account yet, he must create one, it only takes a few minutes)

4- The customer's cart is displayed. If the customer already had a basket waiting, the previously selected items are displayed. The customer then validates his order, he has the possibility of removing the unwanted products by clicking on the icon of the small dustbin which appears on the left.

5- Once the order is validated, the customer selects his payment method. The payment is made via credit card.

6- The customer must then declare to have read and accepted the General Conditions of Sale.

7- Finally, the customer must check the delivery address and modify it if necessary.

Unless otherwise specified by the Customer, the billing address will automatically be the same as the delivery address.

8- Payment is made via the secure Stripe system. The customer is then redirected to the secure Stripe payment page which allows him to pay online. The payment is made by credit card only, the customer must then fill in his bank details (credit card number, validity date and the three numbers of the visual cryptogram on the back of the card). If the payment is accepted, the customer will be redirected to an order confirmation screen on the Site. The request for authorisation to debit the card is made at the time of validation of the order on the site, except in the event of unavailability of servers.

10- The customer validates his payment, he then obtains a summary of his order with his delivery and billing address.

11- The customer receives a confirmation email summarizing his order.

The validation of the order by the customer and the confirmation of the order sent to the customer by e-mail is equivalent to the conclusion of a sales contract between the Parties and acceptance of the General Terms of Sale.

In accordance with the provisions of article 1348 of the Civil code, the purchase orders and the invoices will be filed on a reliable and durable support, constituting a faithful copy. The computerized registers of Clap Paris will be considered by the parties as proof of the contractual relations occurred between the parties.

Clap Paris reserves the right to cancel or refuse any order from a customer with whom there is a previous dispute or the existence of any risk.

ARTICLE 5 - DELIVERY AND GEOGRAPHICAL AREA

Deliveries are made to France, the European Union and the whole world.

Orders are sent within two to six working days (for an order placed on a Monday, you will receive it at the latest on Wednesday of the following week), except on public holidays and from the day following the payment of the order.

Deliveries are made to the address indicated on the order form.

If the delivery time is exceeded and not justified by a case of force majeure, the customer may request the cancellation of the sale and obtain a refund of the sums paid for the sale within a maximum period of thirty days.

Clap Paris reserves the right to refuse to carry out a delivery or to honour an order emanating from a customer with whom there would be a dispute of payment previous or in progress (such as the payment of an unpaid order).

The transfer of the risks of loss and deterioration of the products will be realized after delivery and reception of the products by the customer.

ARTICLE 6 - COMPLAINTS & RETURNS

6-1 CLAIMS

The Customer is responsible for verifying the conformity of the Products received in execution of his/her order at the time of delivery. Any anomaly concerning the delivery such as :

  • missing products,
  • deteriorated products,
  • products that do not conform to the order,

must be notified within a period of fourteen calendar days to exercise its right of withdrawal.

This notification will be sent to the customer service Clap Paris:

After this period, no claim will be accepted, the products being then considered as conforming.

For any return of non-conforming product, the customer will have to address his parcel to the following address

The risks and costs of return are the exclusive responsibility of the customer.
The product must be returned in its original packaging, new and unworn.

When the non-conformity has been noted, Clap Paris will propose to the customer :

1/ the replacement of the product(s) at the expense of Clap Paris (with the reimbursement of the expenses of return of the nonconforming product (according to the tariff grid of the formulas delivery Colissimo without registered posted by the Post office to March 1st of the current year). This operation will be done at the latest in the thirty days as from the date of sending of the notification of the confirmation of the nonconformity.

2/ the refund of the price of the order (price of the products and delivery charges) as well as the expenses of return of the nonconforming product (according to the tariff grid of the formulas delivery Colissimo without registered posted by the Post office to March 1 of the current year). This operation will be done at the latest in the thirty days as from the date of sending of the notification of the confirmation of the nonconformity.

The Customer must send proof of the return costs incurred to the Customer Service Department, by e-mail to hello@clap-paris.com

In case of abnormal or abusive complaints, Clap Paris can refuse to serve a later order.

6-2 RETURN

Customers, non-professional individuals, have a withdrawal period of fourteen days from the receipt of their order. They can thus return their product for exchange without penalty, except for the return costs. The product must be returned in its original packaging, new and unworn.

Attention: In accordance with the law, the products having been the subject of a personalization are excluded from the possibility of retractation.

 

ARTICLE 7 - PERSONAL DATA

The information thus collected within the framework of the treatment of the orders are strictly confidential and are mentioned by an asterisk (*) when they are essential within the framework of the management of the order of the Customer. Clap Paris is committed not revealing this information.

 

ARTICLE 8 - COOKIES

Clap Paris uses cookies in order to recognize the consumer when he/she connects to its site. The cookie is a computer file, stored on the hard disk of the customer's computer, which aims to indicate his passage on the site.

The consumer can deactivate the use of these cookies at any time by selecting the appropriate settings in his browser.
